1. Our Commitment to Copyright
MixinMEup respects the intellectual property rights of artists, photographers, songwriters, labels, publishers, and all other rights holders. We expect our users to do the same. Posting content you do not have the right to share — including recordings, lyrics, photos, artwork, or videos — is a violation of our Terms of Service and may constitute copyright infringement.
MixinMEup is based in Alberta, Canada, and operates under the Copyright Act (R.S.C. 1985, c. C-42). We also acknowledge the copyright concerns of rights holders in other jurisdictions, including those operating under the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512). We respond to properly submitted copyright infringement notices from rights holders worldwide.
2. Reporting Copyright Infringement
If you believe that content on MixinMEup infringes your copyright or the copyright of someone you are authorized to represent, you may submit a written notice to our designated copyright agent (see Section 3 below).
To be effective, your notice must include all of the following:
- Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed, including sufficient detail to identify it (e.g., title, author, publication date, registration number if applicable). If a single notice covers multiple works, you may provide a representative list.
- Identification of the infringing material. The URL or specific location on MixinMEup of the material you claim is infringing, with enough detail to allow us to locate it. A general reference to a profile page is not sufficient — please identify the specific content.
- Your contact information. Your full legal name, mailing address, telephone number, and email address. We will use this to follow up with you about your notice.
- A statement of good faith belief. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy. A statement that the information in your notice is accurate and, under penalty of perjury (or equivalent solemn declaration in your jurisdiction), that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Your signature. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Notices that are incomplete, inaccurate, or submitted in bad faith will not be actioned and may expose the sender to legal liability. If you are unsure whether content infringes your copyright, we recommend consulting a legal professional before submitting a notice.
3. Where to Send Your Notice

Email is the preferred method. Notices sent by email are processed faster than postal submissions. Please write "Copyright Infringement Notice" in the subject line.
4. What Happens After You File
When we receive a complete and valid copyright infringement notice, we will:
- Review the notice to confirm it includes all required information
- Promptly remove or disable access to the allegedly infringing content
- Notify the user who posted the content that their content has been removed and the reason why
- Inform that user of their right to file a counter-notice if they believe the removal was in error
- Retain a record of the notice for our repeat-infringer policy
We aim to process valid notices within 2 business days of receipt. We will not share your personal contact information with the user whose content was removed beyond what is legally required.
5. Counter-Notice Procedure
If your content has been removed and you believe the removal was made in error — for example, because you have a licence to use the content, or because it qualifies as fair dealing or fair use — you may submit a counter-notice to our copyright agent.
A valid counter-notice must include:
- Your contact information. Your full legal name, mailing address, telephone number, and email address.
- Identification of the removed content. A description of the content that was removed and its former location on MixinMEup (the URL before removal, if known), sufficient for us to identify it.
- A statement of good faith belief. A statement, under penalty of perjury (or equivalent solemn declaration), that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
- Consent to jurisdiction. A statement that you consent to the jurisdiction of the courts in the Province of Alberta, Canada (if you are located in Canada), or the federal district court for the judicial district in which your address is located (if you are located outside Canada), and that you will accept service of process from the party who filed the original notice.
- Your signature. Your physical or electronic signature.
Send your counter-notice to dmca@mixinmeup.com with "Copyright Counter-Notice" in the subject line. Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have initiated legal proceedings to restrain the use of the content, we may restore the content at our discretion.
6. Repeat Infringers
MixinMEup has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. If a user's content is the subject of multiple valid copyright infringement notices, we may suspend or permanently terminate their account without prior warning, at our sole discretion.
7. Fair Dealing & Fair Use
Not all use of copyrighted material constitutes infringement. Before submitting a notice, please consider whether the use may be permitted by law:
- Fair dealing (Canada): Under the Copyright Act, certain uses of copyrighted works — including for the purposes of research, private study, education, parody, satire, criticism, review, and news reporting — may be permitted without the rights holder's authorization, subject to the use being "fair" in the circumstances.
- Fair use (United States): Rights holders based in the U.S. should be aware that under 17 U.S.C. § 107, certain uses of copyrighted material may qualify as fair use and are not infringement.
Submitting a copyright notice in bad faith — for example, knowingly misrepresenting that material is infringing — may expose you to liability for damages, including legal costs incurred by the affected user.
